Debtor Abroad

Is your debtor based abroad? Then various factors can play a role, such as different language, culture and payment habits, which means that the risks associated with the collection procedure are greater than for debtors from your own country. However, these factors are not an obstacle for Law & More lawyers. We do not let the borders hold us back and we are therefore happy to guide you through a collection process in which the debtor established abroad, in or outside Europe.

First, Law & More lawyers can go through the normal Dutch collection procedure with you and your foreign debtor, as described earlier. Is your debtor established within the EU? Then you can also opt for the European Payment Procedure. This procedure can only be followed if your claim is not disputed by the debtor. The relevant proceedings are started by means of a request to the court. The competent court then sends a payment order to the debtor. If the debtor does not respond within 30 days, the payment order will be declared enforceable and can be executed immediately throughout the EU (except in Denmark). Does your claim amount to no more than € 2,000? Then you can also opt for the European Procedure for Small Claims. This procedure is often chosen if the collection costs are expected to be higher than the proceeds of the claim and because this procedure focuses primarily on simplicity, low costs and speed. The judgment can then be enforced directly in every EU member state (except Denmark).
